Archibald Charles Head duly sworn and deposed:

I am 17 years of age I live with Mr. Stewart the plaintiff. Mr. Stewart sent me to fetch Hilda back seeing the traces of her footsteps led towards Mrs. Rex . I went over there and asked if they had seen her. Herbert Rex pointed out to me the place where she had passed, I went there and found the footsteps and went from there to Mr. Norsworthy’s. I met Mr. Carr on horseback a little before I got there. I asked him if he saw anything of her, he told me he saw somebody walking in the distance, I couldn’t see her. After we had got to Mr. Norsworthy’s he turned off in quite a different direction from that in which he stated he saw the child. I caught sight of the child a little way from Norsworthy. When I got about one hundred yards from her Mr. Carr galloped past me and got in front of the child & stopped her then I ran up & caught her. Mr. Carr offered to let her have a ride on the horse and I thinking she was tired helped her up. When we got near Mr. Rex’s I wanted to take her but he would not let me. Then Mr. Herbert Rex came up on horseback. I still wanting the child he said he would ride me down if I did not get out of the way then Mr. Carr and Mr. Rex rode with the child up to Mrs. Rex’s house. She was taken in and Mr. Rex said she would not give her up unless Mr. Stewart brought the papers to show that he had a right to her. I then returned with Singer to sunride.
